The visitor account is for people who do not live in France: French nationals living abroad, foreign residents, tourists. It lets you follow local news, keep a calendar, ask associations questions and contact local businesses, like a city guide. If you live in France, including its overseas territories, please create a citizen account.

This English version is a translation provided for information only. Only the French version is legally binding.

Article 1 — Purpose and scope

These Terms of Use govern access to and use of the Ma Démocratie.fr platform by holders of a visitor account (the "Visitor").

The platform is published by JSC DIGITAL, a simplified joint-stock company with a sole shareholder (SASU) and share capital of €1,000.00, registered with the Aix-en-Provence Trade and Companies Register under number 999 457 526, whose registered office is at 11 boulevard de la Grande Thumine, Parc d'Ariane – Bâtiment E1, 13090 Aix-en-Provence, France, represented by its President, Mr Julien Scarella, data controller within the meaning of the GDPR ("Ma Démocratie.fr").

These Terms supplement the General Terms of Use available from the platform's home page. In the event of a conflict, these specific Terms prevail.

The visitor account is entirely free. No recommendation algorithm, no sale of your personal data.

Article 2 — Access conditions

2.1 Residence outside France

The visitor account is reserved for individuals whose main residence is outside France. For the purposes of these Terms, France means metropolitan France, the overseas departments and regions and the overseas collectivities (Saint Pierre and Miquelon, Saint Barthélemy, Saint Martin, Wallis and Futuna, French Polynesia), New Caledonia and the French Southern and Antarctic Lands.

When signing up, the Visitor states their country of residence and certifies, by ticking an unticked box, that they do not live in France. A person who lives in France signs up with a citizen account, governed by the Citizen Terms of Use, and may not hold a visitor account. Nationality is irrelevant: a French national living abroad may open a visitor account; a foreign national living in France opens a citizen account.

2.2 Minimum age

A visitor account may only be created by a person aged at least fifteen (15). The date of birth provided at sign-up is used to check this condition.

2.3 Required information

Sign-up requires the following information: first name, last name, date of birth, country of residence, a valid email address and a password. No postal address, telephone number or municipality is requested. This information must be accurate; an account opened under a false identity or on an inaccurate statement of residence may be suspended or deleted.

2.4 A single, strictly personal account

A person may hold only one account on the platform. The visitor account gives no access to any management area: it does not allow acting on behalf of an association, a business, a local authority, an elected official or a candidate.

2.5 Moving to France

A Visitor who moves their main residence to France informs Ma Démocratie.fr by writing to contact@mademocratie.fr. The account is then converted into a citizen account, once the Citizen Terms of Use have been accepted and the information they require has been provided; failing this, the visitor account may be closed.

Article 3 — What you can do

3.1 Follow local news

The Visitor can read the news feed of the territories of their choice: posts by local authorities, associations, businesses, elected officials and candidates. The feed is displayed in chronological order, with no recommendation algorithm, and no payment changes this order, subject to the temporary highlighting of local authority posts described in the Citizen Terms of Use. The Visitor can search for a municipality, an association or a business and browse the directories.

3.2 Keep a calendar

The Visitor can add events published by local authorities, associations and businesses to their calendar and subscribe to it from their phone. Events published by elected officials and candidates cannot be added to a visitor account's calendar. Nobody knows which events are in your calendar; organisers only see a total number of additions, above a minimum threshold.

3.3 Answer "I'll be there" to local authority events

On a local authority post announcing an event, the Visitor can answer "I'll be there" ("Je serai présent"). This is the only reaction available to a visitor account. It is recorded confidentially: the local authority sees the number of answers, never the identity of those who answered. Like any reaction, it requires your prior consent, given by ticking a dedicated, unticked box, which you can withdraw at any time from your settings; withdrawal deletes your answers.

3.4 Ask an association a question

From an association's page, the Visitor can send it a question. The question is forwarded to the association's managers with your first and last name; it remains private. The number of questions is capped per day and per association.

3.5 Contact a business: booking, order, quote, appointment

From a business's page or post, the Visitor can write to it and send a request — book a table or a room, reserve or order a product, ask for a quote, make an appointment — by providing their contact details. Depending on the business's choice, the button opens its own tool, prepares a text message or forwards the request by email.

Ma Démocratie.fr forwards the request without keeping it. It does not confirm any booking, collects no payment and is not a party to the relationship between the Visitor and the business; the business's external tools are subject to their own terms. The business undertakes not to use your contact details for any purpose other than answering your request.

Article 4 — What the visitor account does not allow

Taking part in local democratic life requires a connection to a French territory and is reserved for citizen accounts. The visitor account therefore does not allow you:

  • to react to posts, except for the "I'll be there" answer described in Article 3.3;
  • to interact with elected officials and candidates: send them a question or proposal, follow a campaign, request a programme, add their events to your calendar;
  • to take part in local authority consultations and petitions, or to send them a proposal or report;
  • to recommend a business;
  • to register or manage an association or a business, or to post on the news feed.

The following are also prohibited: identity theft, an inaccurate statement of residence, holding several accounts, sending questions or requests in bad faith, abusive, for harassment or for canvassing purposes, and any attempt to circumvent these limits. Such breaches may lead to the immediate suspension of the account.

Article 5 — Your personal data

Ma Démocratie.fr does not sell your data. Ever. To anyone.

5.1 Data collected

Ma Démocratie.fr, published by JSC DIGITAL as data controller, collects at sign-up: first name, last name, date of birth, country of residence, email address and password (stored in encrypted form). It then processes the territories you follow, the content of your calendar, your "I'll be there" answers and the questions you send to associations. Requests sent to businesses are forwarded to them without being stored.

5.2 Purposes and legal bases

This data is used to create and manage your account, to check the access conditions (age, residence outside France), to provide the features described in Article 3 and to keep the platform secure. This processing is based on the performance of these Terms; the recording of your "I'll be there" answers is based on your consent.

5.3 What others can see

Associations see the content of your questions with your first and last name. Businesses see the content and contact details of the requests you send them. Local authorities see the number of "I'll be there" answers and of calendar additions, never your identity. Nobody sees your email address, date of birth, country of residence or the content of your calendar.

5.4 Hosting, processors and transfers

The platform's technical providers (hosting, service emails) act as processors and may not use your data for their own purposes. Their identity, where the data is processed, any transfers outside the European Union and the related safeguards are set out in the Privacy Policy (in French).

5.5 Your rights

You have the right of access, rectification, erasure, portability, objection and withdrawal of consent, which you can exercise at any time by writing to contact@mademocratie.fr. Every request is answered within thirty (30) days at most. You may lodge a complaint with the CNIL (www.cnil.fr) or with the data protection authority of your country of residence.

Article 6 — Account deletion

You can request the deletion of your account at any time by writing to contact@mademocratie.fr from the associated email address. Deletion is carried out within thirty (30) days and erases your personal data, your calendar and your answers, except for data that must be kept under a legal obligation.

Ma Démocratie.fr may suspend or delete an account in the event of a serious or repeated breach of these Terms, in particular an inaccurate statement of residence, after informing the Visitor where possible.

Article 7 — Language, acceptance and changes

These Terms are written in French. An English translation is provided for information only; in the event of any discrepancy, only the French version is binding.

Acceptance of these Terms is given by ticking an unticked box when creating the account. Consent to "I'll be there" answers is given by a separate, optional box; not giving it does not prevent the account from being created.

Ma Démocratie.fr may amend these Terms. Any substantial change is notified by email before it takes effect; if you do not accept it, you may request the deletion of your account.

These Terms are governed by French law, without prejudice to any more protective mandatory provisions of the Visitor's country of residence when acting as a consumer.
